What is a pro se divorce?

Pro se is Latin for “on one’s own behalf.” This means that the person seeking a divorce represents themselves. The person is responsible for paying the filing fee and any associated costs with the divorce, as well as representing themselves at the hearing. Sometimes called a “do it yourself” divorce, this is an increasingly common way in Arkansas to pursue a routine divorce while saving money.

What States do you cover?

We currently only offer this service in Arkansas.

How much does it cost?

We charge a one time flat-fee of $350.

What is required for a divorce in Arkansas?

You must be a resident of Arkansas for at least 60 days before filing, and have grounds for divorce.

What are grounds for divorce?

Grounds may be either 1) separation for more than 18 months 2) general indignities 3) adultery 4) cruel and barbarous treatment to the point of endangering life.

Do divorces with children or contested divorces cost more?

No. We offer the same package for all divorces. This does not mean that a pro se divorce is necessarily the best option if you have contested issues or children, but that we don’t charge more.

Will there be any other costs?

Yes. You must pay your filing fee at the courthouse in person. That is usually about $165. You also may have other smaller fees, such as hiring a process server. But with us, there are no additional or hidden fees.

How is this different from cheaper “online” divorces?

Other pro-se divorce services are simply automated form generators: you enter basic information and a program completes the forms for you, usually without a real person ever checking them. At Arkansas Affordable Divorces, your documents are drafted and reviewed by a real paralegal, and you get legal advice, instruction and tips going forward from a real lawyer.

Will this make you my lawyer?

Only for the limited purposes of drafting your documents, answering your questions and providing your initial legal advice and instructions. We do not enter our appearance in your divorce, promise to represent you in the divorce, or anticipate an attorney-client relationship moving forward.

Is a pro se divorce always advisable?

Not at all. If it is a contested divorce involving children or substantial property, you almost always want to hire an attorney to represent you fully in the divorce.

Also, if your divorce is complex, or you want a complex agreement with your spouse concerning issues such as visitation or property, a pro se divorce is probably not for you.

So what kind of divorces are best pro se?

The simpler divorce, the better (and easier for you!) If your spouse agrees and it is uncontested, that’s a good candidate for a pro se divorce. If your spouse will sign then sign paperwork that they agree with the divorce and waive service, that’s the best candidate for a pro se case.
